The four reasons for Grounds For Divorce are:
 
1. Adultery
  Adultery is defined as a married man/woman having sexual intercourse with a party who is not his/her spouse. Adultery evidence can also be established if there is a proof of inclination and opportunity.
 
2. Unreasonable Behaviour
 
  • The behaviour of the respondent must affect the marriage and spouse relationship.
  • There must be proof of series of negative conduct and acts of omissions.
  • There respondent's behaviour, whether passive or active may be taken into consideration.
 
3. Desertion ( At Least Two Years)
 
  • The respondent leaves the petitioner due to his/her unreasonable behaviour or belief of committing adultery.
  • The respondent is not considered as desertion if he/she leaves the family due to a reasonable cause. e.g. posted overseas for job assignment.
 
4. Separation
 
  • Respondent and petitioner living apart for three years or more with consent.
  • Respondent and petitioner living apart for four years or more without consent.
