Who may ask for custody of the child
Either parent may ask for the custody of the child. However there
maybe certain cases which Court will think it more appropriate to
give the custody of the child to a relative of welfare organization.
When to apply for custody
The custody of child may be applied ant any time during the
marriage, separation or divorce.
How to apply for custody
Either parent may apply to the Family Court for the custody of the
child.
Considerations for custody
Court may consider the wishes of both parents and the wishes of the
child (if the child is old enough to express himself/herself),
however Court will consider the interest of the child as paramount.
Access
When a custody is given to one parent, the other parent is usually
granted permission to spend some time with the child on a regular
basis. Court may deny access to the other parent if it is shown that
such access is not in the best interest of the child. |
